Title: Judge rules in favour of Xan.
Post by: XAN Miniatures on 11 September 2020, 07:46:16 PM
Hi everyone!!

Today I have received the sentence of the judge of the Commercial Court No. 8 of León (Spain) by which the contract with Warmodelling Miniatures SL and Capitan Miniatures SL is resolved and orders them to pay a compensation.

This brings a heritage of 3,000 miniatures home, and I will gradually release all the miniatures from the old Fantassin catalogue. If there is room for any doubt, the termination of this contract confirms that Stonewall lacks any right to exploit said miniatures, since it was an exclusive contract with said companies and they could not assign rights to third parties; now my authors association will deal with the British Justice.

I consider this to be relevant news because I think there are many fans who wanted to complete their ranges and could not do so due to the poor condition of the moulds used by them.
All the moulds will be made new and many figures will be improved. I hope to make as many numbers as possible available to fans in the shortest time possible.

Best Wishes!

What?!  Stonewall are casting figures that they have no legal rights to?!  I'm shocked!  Shocked I tell you...  ::)

Well done and best of luck in getting your property back.

They obviously haven't heard the news or bothered to update their website:

https://www.stonewallfigures.co.uk/

Maybe that's what Brexit was really all about?  :D

Congratulations BTW!

So, forgive my ignorance, does this mean Stonewall shouldn't be selling the Capitan ranges?

As I like the look of a lot of the figures and have often considered the Carlist range, but if they don't have the rights I will hold on to my money until I can get them from the legal source!

What Stonewall can´t neither sell nor produce are the 15mm and 20mm miniatures ranges previously sold by Fantassin/Warmodelling, all  modelled by Xan. So the ranges in Stonewall web that are illegal are:
Capitan 15mm ancients
Capitan 15mm napoleonics
Capitan 20mm WW2
Capitan Carlist Wars
Capitan Spanish American War

I hope that helps.

Milo.

Or indeed all the other stuff he's pirated in the past: AB Figures, FAA, Testudo...
