The 45e Regiment de Ligne was already a veteran French line regiment in 1808 when it supplied a battalion to the 9th Provisional Line Regiment, part of Marshal Moncey's Corps that was part of Napoleon's first invasion of Spain in the January of that year.

By January 1809, the regiment's first three battalions would be based in Salamanca and engaged in a five month long struggle with Sir Robert Wilson's Loyal Lusitanian Legion together with Portuguese and Spanish militia and irregular forces, prior to its involvement in the Talavera campaign in July.
