Allegedly Ken does not have the financial means to bring suit against Defiance.  The quote suggests some feel you can sue as a result of Defiance not delivering on the kickstarter.  I strongly doubt that can or will happen for the reasons I gave.

Fair enough, I withdraw my statement. Not an attorney, so I really don't know what can and can't be done.

You kind of make it sound like a person or company could conceivably set up a Kickstart with the full intention of NOT fulfilling it, with the full intention of walking away with the cash, and no legal repercussions at all. There's really no recourse?

Has anyone pulled a huge, full blown, intentional Kickstarter scam? If no, why the heck not? People scammed traumatized Katrina and 9/11 victims for chrissakes, what's stopping people from doing a KS and retiring to the Caribbean?

Hmm, now I feel a little dirty.  I purchased some of the Proxie barriers from Miniature Market (under the Defiance name).  Looks like Proxie won't see a dime of that.

I wonder if Rust Forge is getting paid for the containers?

Anyway, if someone knows anyone that pledged for the kickstarter, they should throw up the situation in the comments and see if DG responds.

And my issue in respect if non payment of a supplier also stands as any company should honour it's business responsibilities, which Defiance appear from the information provided. ...haven't.

So I think both agree on our respective points.  :)

Yep, if you read the fine print there really is ZERO legal ramifications if a kickstarter group bails on you after you have the money.  I suspect this is exceedingly rare, and with a clever enough attorney people could "find a way".  On the flip side, a collective group of people could simply make the person's life a living hell (reddit anyone?).

This is one of the reasons why I limit my Kickstarter stuff to people who have a known reputation (or are known locally) or to companies I trust.

Indeedy. And even if most folks know this already, them rulez iz always worth a rehash once in a while because some always don't o_o

KenOfYork's case is an entirely different kettle of fish of course.

Then again I would assume that you could take the issue up with Kickstarter, in a "did you know you're hosting a project by a company known for fraudulent business dealings" manner or something similar?

One assumes that might prevent the party guilty of fraudulent business practices from starting a new KS since it would be bad publicity for Amazon to continue to support such ventures.

They have to come up with a scape goat to placate the suckers who still, after years of the same old BS, feel loyalty to them and freely part with their money to get junk (or nothing) in return.
