After my Letter before Action, my first parcel did turn up - looks like base game plus some add-ons - I haven't opened it yet as I've been swamped with Christmas stuff, it's awaiting me for after the family duties are done - sadly I think that this sort of path is the only thing that focuses the mind(s) at Prodos, and for the cost of a couple of hours research and drafting plus a couple of quid in recorded post fees, it was a trade off I'd recommend if it's open to you (I think the EU citizens would have legal standing in the UK courts, but I don't think it would work for US residents - but I'm not an expert on this).

Were the add-ons in retail packaging?

Will let you know when I unwrap it - it's still in the black pallet wrap at the moment - going from other's photos of the unwrapped to open, I doubt they are in retail packaging, but that's pure speculation on my part. (I would open it now to check, but mrs rich wouldn't appreciate another large package of smaller bits being opened before Christmas while she's wrapping anything and everything that doesn't move (the cat had a lucky escape).

Didn't Prodos relocate to Poland over the Autumn? Or was it some other miniature company? Which might actually be a good thing if somebody has a legal bone to pick with them (this KS doesn't strike me as actionable, mind you).

Why would it be a good thing for Prodos to have closed their UK ops in order to avoid their legal obligations?

UK has negotiated exceptions with EU that might extent to EU citizen rights in consumer complaint matters, whereas Poland I would think is less likely to have such in place. Obviously I'm not aware if any such would apply here. Whatever the case, it'll likely be quite hard to any compensation out of them if they flatly refuse to refund -- as they have stated they are doing previously.

The physical operations seem to have been entirely moved to Poland (although I don't believe that there was a lot going on in the UK anyway - just a sales office for Rob Alderman & Andy).  The corporate bodies however are all registered as UK companies which make them actionable in the UK - the website lists one UK address and companies house another (and the other address is where all of the 'non-prodos' Jarek Evertowski owned/ part-owned companies are registered).

Any successes in the courts would be enforceable whenever Prodos were active in the UK (such as Salute, or their meetings with Fox).  While this remains the case, proper legal steps are likely to focus Prodos' mind on satisficing those taking them.

Which company did the backers pay?

Backers directly paid KS via Amazon Payments (which KS used at the time).  KS then takes their cut and passed the rest to Prodos Games Ltd (that was the company listed on the KS).

Even though it's predated there's been a striking-off notice issued.

https://beta.companieshouse.gov.uk/company/08373380/filing-history/MzEzODA3MjgwNGFkaXF6a2N4/document?format=pdf&download=0

It hasn't filed it's accounts, up to Jan 2014, since March 2014. No accounts for the bulk of 2014, and unlikely for 2015 too. If this is unchallenged by Feb 29th the company will cease to exist as will it's liabilities, which are only limited to £1000 anyway.

Meanwhile the accounts for PRODOS LTD are up to date, while another company connected by director, WASTEFALL LIMITED is new and not due. From: https://beta.companieshouse.gov.uk/officers/3jVCWaZBaTkF396PxzQab5S9Qb0/appointments

I wonder if PRODOS GAMES LTD was the company which held the licence from Fox.

Those who have been lucky enough to get their packages - were these posted from the UK? Did you get a receipt or similar with them? Was that from the UK company Prodos Games Ltd?

I have been told that Prodos Ltd was Jarek's pre-gaming company, and that Prodos Games Limited is the one that holds the deal with Fox.  My parcel came from Poland but is unopened until tomorrow (I have family today) so I don't know if there is a receipt inside it.
